  3. SMS Communications (A2P)

    • To send you appointment reminders, service updates, promos, and marketing messages—but only if you’ve explicitly opted in.

    • To comply with CTIA and carrier requirements, we’ll honor opt-out requests instantly.

  4. Analytics & Improvement

    • To understand site performance, measure ad campaign effectiveness, and enhance user experience.

  5. Legal & Compliance

    • To comply with laws, regulations, and contractual obligations (e.g., recordkeeping for authorized opt-ins).

4. Legal Basis for Processing (EU/California Residents)

  • Consent: For marketing emails, SMS, re-marketing via Google/Facebook, and any other direct marketing messaging.

  • Contractual Necessity: To fulfill service requests, send invoices, schedule installations, etc.

  • Legitimate Interests: To improve our website, detect fraud, run targeted and retargeted ads (with your ability to opt out), and ensure network security.

BP Desert Concrete uses an approved A2P SMS provider. We honor all CTIA, FCC, and industry-standard guidelines. Here’s the TL;DR:

  1. Opt-In: You must explicitly text “YES” or complete a form acknowledging that you want to receive SMS from us.

  2. Opt-Out: Reply “STOP” at any time, and we’ll immediately remove you from the list and send a confirmation “You have been unsubscribed.”

  3. Message Frequency & Timing: We’ll text no more than 4 messages per month, and only between 9 AM and 8 PM Pacific Time.

  4. Costs: Msg & data rates may apply. Check with your carrier.

  5. Privacy: We won’t share your number with third parties without your OK, except our SMS service provider, who abides by this policy.

7. Sharing & Disclosure

  1. Service Providers

    • Google Ads, Facebook Ads (for audience targeting; data is hashed before upload).

    • SMS aggregator/platform (to send text messages).

    • CRM or email marketing platform (e.g., for newsletters).

  2. Legal Requirements

    • We may disclose info if legally required (court order, government request) or to enforce our policies.

  3. Business Transfers

    • If BP Desert Concrete merges, is acquired, or sells assets, we’ll share data with the new entity—under the same terms.

8. Data Retention

  • Leads & Contacts: Retained as long as we have a business relationship, plus up to 3 years for re-marketing purposes (in accordance with industry standards).

  • SMS Records: Stored for at least 24 months to document compliance with carrier requirements.
